Question 1

What is FISP / Local Law 11 in NYC?

Accepted Answer

FISP (Facade Inspection Safety Program), formerly known as Local Law 11, is a New York City regulation requiring buildings taller than 6 stories to have their exterior walls and appurtenances inspected by a Qualified Exterior Wall Inspector every 5 years. The inspection report must be filed with the NYC Department of Buildings. DOB lists civil penalties by category for late filing, failure to file, SWARMP, and Unsafe conditions.

Question 2

How much are the fines for missing a FISP deadline in NYC?

Accepted Answer

NYC building owners can face DOB civil penalties for failing to file the required FISP facade inspection report. DOB lists $1,000 per month while an acceptable report is not filed and $5,000 for each year after the sub-cycle filing window closes, with separate SWARMP and Unsafe-condition penalties.

Question 3

What does a facade inspection include?

Accepted Answer

A FISP facade inspection includes a close-up examination of the building's exterior walls, balconies, railings, fire escapes, and other appurtenances. A licensed Professional Engineer inspects for deterioration, cracks, loose elements, water damage, and structural issues. The building is then classified as Safe, SWARMP (Safe With A Repair and Maintenance Program), or Unsafe. A detailed report is filed with the NYC DOB.

Question 4

How do I resolve a DOB violation in NYC?

Accepted Answer

To resolve a DOB violation in NYC: 1) Review the violation notice to understand requirements, 2) Hire or coordinate with the required licensed professional to create a corrective action plan, 3) Perform the necessary repairs with licensed contractors, 4) File for violation dismissal with the DOB.
